Discord Bot Terms of Service (TOS)

1. Introduction

This Terms of Service document (hereafter referred to as "TOS") establishes the legal agreement between the user (hereafter referred to as "User" or "You") and BrainGen Labs (hereafter referred to as "the Owner"), governing the use of MODO AI SERVICES (hereafter referred to as "the Bot" or "the Application") deployed on the Discord platform. By engaging with the Bot, You consent to be legally bound by these provisions. Should You disagree with any part of this TOS, You are advised to cease the use of the Bot forthwith.

2. Ownership and Intellectual Property Rights

The Bot is exclusively owned and operated by the Owner. All intellectual property rights related to the Bot, inclusive of but not limited to copyrights, trademarks, patents, trade secrets, and any other forms of proprietary rights, are and shall remain the sole property of the Owner. Usage of the Bot does not confer upon the User any form of ownership or rights to the intellectual property of the Bot.

3. User Conduct

Users are mandated to adhere to the terms of service and community guidelines set forth by Discord when utilizing the Bot. Responsibility for the User's actions whilst engaging with the Bot rests solely with the User. It is expressly forbidden for Users to partake in any activities deemed illegal, harmful, offensive, or disruptive to the experience of other Users. The Owner reserves the unconditional right to terminate access to the Bot for any User found in violation of these terms or engaging in prohibited activities.

4. Privacy Policy

The Owner is deeply committed to respecting and protecting the privacy of Users. Detailed information on the collection, utilization, and disclosure of personal information is provided in our Privacy Policy, which Users are encouraged to review.

5. Disclaimer of Warranties

THE BOT IS MADE AVAILABLE TO USERS ON AN "AS IS" BASIS, WITHOUT ANY FORM OF WARRANTY WHATSOEVER. THE OWNER HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, QUALITY, OR USEFULNESS OF THE BOT.

6. Limitation of Liability

IN NO EVENT SHALL THE OWNER BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE BOT, REGARDLESS OF THE NATURE OF THE CLAIM.

7. Governing Law and Jurisdiction

This TOS shall be governed by and interpreted in accordance with the laws of The United States/Louisiana, disregarding its conflict of law principles. Any disputes arising under or in connection with this TOS shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

8. Changes to This TOS

The Owner reserves the right, at its sole discretion, to modify, amend, or replace this TOS at any point in time without prior notification. Continuation of use of the Bot by the User following such modifications constitutes acceptance of the revised TOS.

Privacy Statement for BrainGen Labs and MODO AI SERVICES

At BrainGen Labs, the privacy and security of our users are of paramount importance. This Privacy Statement outlines our practices concerning the collection, use, and disclosure of personal information through the use of MODO AI SERVICES (the "Bot") on the Discord platform.
